Acceptance of these Terms

These Terms of Use ("Terms") govern your access to and use of lendpilots.app and any related services provided by Lend Pilots (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

Eligibility and use

You may use the Services only if you are at least 18 years old and have legal capacity to enter into a binding contract. The Services are directed at residents of Alberta and other Canadian provinces and territories. If you access the Services from outside Canada, you do so at your own risk and are responsible for compliance with local laws.

The Services are not an offer to lend

The Services, including all rates, fee estimates, case studies, calculators, FAQ content, and pre-qualification submissions, are provided for informational purposes only. They do not constitute an offer or commitment to lend or to broker a mortgage. A lending decision is only made after a complete file has been underwritten, an appraisal has been received, and a written commitment letter has been issued and signed.

Your submissions and accuracy

When you submit information through our pre-qualification form or by email, you confirm that the information is true, accurate, and complete to the best of your knowledge, and that you are authorized to share it. Submitting false, misleading, or incomplete information may result in your file being declined and may, in some circumstances, expose you to civil or criminal liability.

Consent to be contacted

By submitting the pre-qualification form, you consent to being contacted by Lend Pilots about your inquiry — and, if your file falls outside Lend Pilots' lending criteria, to being referred to and contacted by a partner lender in our network. You may withdraw this consent at any time by emailing underwriting@lendpilots.app. The pre-qualification form is a soft inquiry only — we do not pull credit at this stage. A credit inquiry, where applicable, only occurs with your separate written authorization.

Intellectual property

All content on the Services — including text, graphics, logos, photographs, layouts, code, and the "Lend Pilots" name and marks — is owned by Lend Pilots or licensed to it, and is protected by Canadian and international copyright, trademark, and other intellectual-property laws. You may view and print content for your personal, non-commercial reference. Any other use, including copying, redistribution, modification, reverse engineering, or commercial use, is prohibited without our prior written permission.

Acceptable use

You agree not to:

• Use the Services for any unlawful, fraudulent, deceptive, or abusive purpose;
• Submit content that is false, misleading, defamatory, or infringes the rights of any person;
• Attempt to gain unauthorized access to our systems, scrape data at scale, or interfere with the Services' operation;
• Use automated means (bots, scripts, scrapers) to submit forms or access non-public content;
• Impersonate any person or misrepresent your affiliation with a person or entity;
• Use the Services to send unsolicited commercial communications.

Bot protection and abuse prevention

We use Google reCAPTCHA v3 and other measures to detect and block automated abuse of our forms. By submitting a form, you agree to Google's reCAPTCHA Privacy Policy and Terms of Service. We reserve the right to block or rate-limit any user we believe in good faith is abusing the Services.

Third-party services and links

The Services may link to or rely on third-party services (for example, Google reCAPTCHA, Google Fonts, Firebase hosting, appraisal vendors, partner lenders, and title insurers). Lend Pilots does not control these third parties and is not responsible for their content, conduct, availability, or terms. Your use of any third-party service is at your own risk and subject to that third party's terms and privacy policy.

Disclaimer of warranties

The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Lend Pilots disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, and uninterrupted availability. We do not warrant that the Services will be error-free, secure, or free from harmful components.

Limitation of liability

To the maximum extent permitted by law, Lend Pilots, its directors, officers, employees, contractors, and affiliates will not be liable to you for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profit, loss of opportunity, loss of data, or damage to reputation, arising out of or in connection with your use of the Services, even if Lend Pilots has been advised of the possibility of such damages. Our aggregate liability for any direct damages arising from your use of the Services is limited to one hundred Canadian dollars (CAD $100). Nothing in these Terms limits liability that cannot, by law, be limited.

Indemnification

You agree to indemnify and hold harmless Lend Pilots and its directors, officers, employees, contractors, and affiliates from any claim, loss, liability, or expense (including reasonable legal fees) arising out of your breach of these Terms, your violation of any law, or your infringement of any third party's rights.

Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if we believe in good faith that you have breached these Terms or that your continued use of the Services poses risk to us, our other users, or our partners. Sections of these Terms that by their nature should survive termination (including intellectual-property, disclaimer of warranties, limitation of liability, indemnity, and governing law) will survive.

Governing law and jurisdiction

These Terms and any dispute arising from them or your use of the Services are governed by the laws of the Province of Alberta and the federal laws of Canada applicable in Alberta, without regard to conflict-of-law principles. The courts of the Province of Alberta have exclusive jurisdiction over any such dispute.

Changes to these Terms

We may update these Terms from time to time. Material changes will be flagged with a new "Last updated" date at the top of this page. Continued use of the Services after a change constitutes acceptance of the revised Terms.
